website, you agree to be bound by these Terms and our Privacy Policy.

1. ABOUT NEXT DAY BADGES
Next Day Badges is operated by Namebadges and More, LLC. We
provide custom name badges and related products through our website at
www.nextdaybadges.com.
For purposes of these Terms, "Next Day Badges,"
"we," "us," and "our" refer to Next Day Badges
and Namebadges and More, LLC, as applicable. "You" and
"your" refer to the customer, website visitor, account holder, or
other person using our website or services.

2. USE OF OUR WEBSITE
You may use our website only for lawful purposes and in
accordance with these Terms.

fraudulent, abusive, or deceptive purpose;

accounts, servers, systems, or networks;

intended to interfere with the operation or security of the website;

Impersonate another person or business or misrepresent your

applicable federal, state, or local law.

access to our website or services when we reasonably believe these Terms have

3. CUSTOMER ACCOUNTS
Certain features of our website may allow or require you to
create an account.
You are responsible for providing accurate, current, and
complete information and for maintaining the confidentiality of your login
credentials.
You are responsible for activity conducted through your
account. If you believe your account or password has been compromised, please
contact us promptly at help@nextdaybadges.com.
We reserve the right to suspend or terminate accounts
containing false, inaccurate, fraudulent, or incomplete information or accounts
used in violation of these Terms.
4. ORDERS AND CUSTOMER INFORMATION
When placing an order, you agree to provide accurate and
complete information, including your name, contact information, billing
information, shipping address, product specifications, artwork, names, titles,
credentials, and other information necessary to complete your order.
You are responsible for reviewing information submitted with
your order for accuracy.
Submission of an order does not necessarily constitute our
acceptance of that order. We reserve the right to decline or cancel an order
when reasonably necessary, including because of product availability, pricing
errors, payment issues, suspected fraud, prohibited content, production
limitations, or inaccurate order information.
If payment has already been collected for an order that we
are unable to accept, we will provide an appropriate refund for the amount
collected for the canceled portion of the order.
5. CUSTOM PRODUCTS AND ARTWORK
Many Next Day Badges products are customized according to
customer-provided names, titles, logos, artwork, colors, layouts, and other
specifications.
You are responsible for ensuring that all information and
materials submitted to us are accurate and that you have the necessary rights
and authorization to use any logos, trademarks, photographs, artwork, graphics,
names, or other materials you provide.
By submitting materials to Next Day Badges, you grant us a
limited, non-exclusive license to use, reproduce, resize, format, modify, or
otherwise process those materials solely as reasonably necessary to prepare
proofs, manufacture your products, fulfill your order, provide customer
service, and maintain appropriate business records.
You retain ownership of your original materials. Submission
of customer materials does not transfer ownership of those materials to Next
Day Badges.
6. PROOFS AND CUSTOMER APPROVAL
When a proof is provided, it is your responsibility to
carefully review the proof before approving it.
You should verify all applicable details, including:
- Names and spelling;
- Titles and credentials;
- Layout and positioning;
- Logo placement;
- General design;
- Badge size and material; and
- Other customization details shown on the proof.
Approval of a proof authorizes Next Day Badges to proceed
with production based on the approved design.
Because custom products are manufactured specifically for
you, changes requested after proof approval may require a new order or
additional charges if production has already begun.
If Next Day Badges produces an item that does not match the
proof you approved because of an error on our part, please contact us so we can
review the issue and determine the appropriate
correction or replacement.
7. COLORS AND PRODUCT APPEARANCE
We make reasonable efforts to represent product colors,
materials, finishes, and artwork accurately.
However, colors displayed on a computer, tablet, or mobile
device may differ from the appearance of the finished physical product because
of differences in displays, printing and sublimation processes, materials,
lighting, and other production factors.
Minor variations that are inherent to the manufacturing or
printing process are not considered defects.
8. PRICING AND PAYMENT
Prices are displayed in U.S. dollars unless otherwise
stated.
Applicable shipping charges, taxes, and other charges will
be presented as appropriate during checkout, invoicing, or order processing.
We reserve the right to correct pricing, typographical,
calculation, or other errors. If an error materially affects an order that has
already been submitted, we will contact you before proceeding when appropriate.
Orders requiring payment before production will not enter
production until the required payment has been successfully received.
Customers with separately approved credit or account terms
remain subject to the terms established for their account.
9. PRODUCTION AND TURNAROUND TIMES
Production and turnaround estimates are provided in good
faith but may vary based on order size, customization requirements, proof
approval, inventory availability, payment status, production volume, and other
circumstances.
When customer approval, artwork, payment, or additional
information is required, production may be delayed until the requested item is
received.
Any stated production or delivery date is an estimate unless
Next Day Badges expressly agrees otherwise in writing.
10. SHIPPING AND DELIVERY
Shipping times are estimates provided by the applicable
carrier and are separate from our production time.
Once an order has been transferred to the shipping carrier,
delivery may be affected by weather, carrier delays, service disruptions,
incorrect or incomplete addresses, and other circumstances outside our
reasonable control.
Customers are responsible for providing an accurate and
deliverable shipping address.
If a package is returned because an incorrect or incomplete
address was provided, additional shipping charges may apply before the order is
reshipped.
Tracking information may be provided when available.
11. RETURNS, REFUNDS, REPRINTS, AND EXCHANGES
Because our products are customized and manufactured
specifically for each customer, custom products generally cannot be returned or
refunded because of a change of mind after production has begun or after a
proof has been approved.
Once a customer approves a proof and production begins, the
approved design is considered authorized for production.
If you receive an item that contains a manufacturing defect,
printing error, or other production issue attributable to Next Day Badges,
please contact us promptly with information about the issue. We may request
photographs or other documentation so that we can evaluate the problem.
When we confirm that an error occurred on our part, we may,
as appropriate, correct, replace, or reprint the affected product.
Errors contained in customer-supplied information or in a
proof that the customer approved are generally not considered production errors
by Next Day Badges.
Nothing in this section limits any rights that cannot
lawfully be waived under applicable law.
12. SMS/TEXT MESSAGING TERMS
Customers may voluntarily opt in to receive transactional
SMS/text messages from Next Day Badges regarding an existing order or customer
service interaction.
Messages may include:
- Name badge proof notifications;
- Requests to review or approve a proof;
- Revised-proof notifications;
- Order-related questions;
- Customer service communications; and
- Other transactional updates directly related to an existing
order.
Message frequency varies. Message and data rates may apply.
Consent to receive SMS messages is not a condition of purchase.
Customers must affirmatively opt in before receiving SMS
communications from this program. Providing a telephone number for another
purpose does not, by itself, constitute consent to receive SMS messages.
You may opt out of SMS messages at any time by replying
STOP. After opting out, you may receive a confirmation that you have been
unsubscribed, and no further messages from that SMS program will be sent unless
you subsequently opt in again.

Wireless carriers are not liable for delayed or undelivered
messages.
Our collection and use of mobile telephone numbers and SMS
consent information is also governed by our Privacy Policy. SMS opt-in
information and consent will not be sold or shared with third parties or
affiliates for their promotional or marketing purposes. We may share
information with service providers only as reasonably necessary to provide the
messaging and order-related services requested by you.
13. EMAIL COMMUNICATIONS
By providing your email address in connection with an order
or account, you agree that we may send transactional communications necessary
to process and service your order, including order confirmations, invoices,
proof notifications, shipping information, and customer service communications.
Where required by law, promotional or marketing email
communications will include an appropriate method to unsubscribe.
Unsubscribing from promotional communications does not
prevent us from sending transactional communications that are reasonably
necessary to service an existing order or account.
14. PRIVACY
Your privacy is important to us.
Our collection, use, storage, and disclosure of personal
information is governed by our Privacy Policy, which is incorporated into these
Terms by reference.
By using our website and services, you acknowledge that you
have reviewed our Privacy Policy.
15. INTELLECTUAL PROPERTY
Unless otherwise indicated, the content of the Next Day
Badges website—including text, graphics, website design, photographs, product
images, logos owned by Next Day Badges, software, and other original content—is
owned by or licensed to Next Day Badges and is protected by applicable
intellectual property laws.
You may not reproduce, distribute, modify, publish, sell,
commercially exploit, or create derivative works from our protected website
content without our prior written permission, except as permitted by law.
Customer-owned logos, trademarks, artwork, and other
customer-provided materials remain the property of their respective owners.
16. COPYRIGHT AND INTELLECTUAL PROPERTY COMPLAINTS
Next Day Badges respects the intellectual property rights of
others.
If you believe material appearing on our website infringes
your copyright or other intellectual property rights, please provide us with
sufficient information to identify the protected work, the allegedly infringing
material, your contact information, and the basis for your claim.

You may voluntarily provide feedback, suggestions, ideas, or
recommendations regarding our website, products, or services.
Unless otherwise agreed in writing, such feedback is not
considered confidential, and you authorize Next Day Badges to use it for
legitimate business purposes, including improving our products, website, and
customer experience.
Providing feedback does not entitle you to compensation or
reimbursement unless we expressly agree otherwise in writing.
18. THIRD-PARTY SERVICES AND LINKS
Our website may contain links to third-party websites or use
third-party services for functions such as payment processing, shipping,

We do not control third-party websites and are not

AVAILABLE" basis.

Next Day Badges or required by applicable law, we disclaim warranties regarding

Nothing in these Terms excludes warranties or consumer
protections that cannot lawfully be excluded.
21. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Next Day
Badges and Namebadges and More, LLC will not be liable for indirect,
incidental, special, consequential, or punitive damages arising from your use
of our website or services.
For claims arising from a particular order, our aggregate
liability will not exceed the amount you paid to Next Day Badges for the
product or service giving rise to the claim, except where a different
limitation is required by applicable law.
Nothing in these Terms limits liability that cannot legally
be limited or excluded.
22. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and
hold harmless Next Day Badges, Namebadges and More, LLC, and their officers,
employees, representatives, and service providers from third-party claims,
damages, liabilities, or reasonable expenses arising from:
- Materials you submit without the necessary authorization or
intellectual property rights;
- Your unlawful or unauthorized use of our website or
services; or
- Your material violation of these Terms.
This section does not require you to indemnify us for claims
caused solely by our own unlawful conduct.
23. SUSPENSION OR TERMINATION
We may suspend or terminate access to an account or service
when reasonably necessary because of fraud, misuse, nonpayment, security
concerns, unlawful activity, or a material violation of these Terms.
Termination of an account does not eliminate obligations
incurred before termination, including outstanding payment obligations.
24. CHANGES TO THESE TERMS
We may update these Terms periodically to reflect changes to
our products, services, business practices, legal requirements, or website
functionality.
When we make changes, we will post the revised Terms on this
page and update the Effective Date.
Your continued use of our website after revised Terms become
effective constitutes acceptance of those revised Terms to the extent permitted

applicable to an order already completed unless required by law or agreed to by
the parties.
25. SEVERABILITY
If any provision of these Terms is determined to be invalid,
illegal, or unenforceable, the remaining provisions will remain in effect to
the fullest extent permitted by law.
26. NO WAIVER
Our failure to enforce any provision of these Terms on one
occasion does not waive our right to enforce that provision or any other
provision in the future.
27. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any
additional terms expressly presented in connection with a particular product,
service, account, quote, or order, constitute the agreement between you and
Next Day Badges regarding your use of the website and applicable services.
28. GOVERNING LAW
These Terms and your use of the Next Day Badges website will
be governed by the laws of the State of Florida, without regard to
conflict-of-law principles, except to the extent applicable federal law or
other mandatory law provides otherwise.
